Insolvency advice in Birmingham

Birmingham business struggling with HMRC arrears, supplier demands or mounting losses? Understand the rescue, repayment and company closure options before the next decision.

Insolvency advice in Birmingham: can your company recover?

If your Birmingham company cannot pay its debts, the first decision is whether it has a viable future and enough funding to reach it. An affordable repayment plan may solve a temporary shortfall. Persistent losses, unpayable arrears or a threatened winding-up petition require a wider review.

Vanguard Insolvency helps directors turn the figures into a practical next step. That means looking at cash due in, bills due out, the work still to deliver and what would actually change under a recovery plan.

When every creditor wants paying first

It is common to keep the business moving by delaying VAT, using a supplier’s credit or adding personal money. The warning comes when each payment merely creates the next gap. Put the bank balance, payroll, tax and essential supplies in one forecast before agreeing another promise. Paying whichever creditor applies the most pressure can leave the business with fewer options.

Our head office is at 83–85 Hagley Road, Universal Business Centre, Cobalt House, Birmingham, B16 8QG. We support directors across Digbeth, the Jewellery Quarter, Edgbaston, Aston and Erdington. Start by telephone or video; please contact us to arrange matters before visiting.

Company rescue, HMRC repayment and liquidation options in Birmingham

If trading can cover current costs and leave a reliable surplus, HMRC Time to Pay may allow arrears to be cleared in instalments. Prepare an offer that includes the next VAT and PAYE bills. HMRC must agree the terms; a proposal alone does not stop court action.

A company voluntary arrangement may help where several creditor balances need a formal compromise. The business needs a credible plan, funding and the required creditor approval. Directors usually continue managing the company, but the agreed contributions and new trading bills must remain affordable.

Administration may be considered if a funded rescue or business sale can achieve the statutory objectives. An administrator takes control, and most enforcement is restricted by a moratorium. The process needs funding and does not guarantee that the original company, every contract or every job survives.

Where losses cannot be stopped or a recovery cannot be funded, CVL offers a formal way to wind up an insolvent company. A licensed insolvency practitioner handles the liquidation. Discuss assets, employees, fees, guarantees and director loan accounts before deciding to proceed.

What will make the first Birmingham discussion useful?

Bring the latest bank position, a creditor list, tax balances and a short forecast. Identify the next payment the company cannot meet and any creditor threatening a specific action. You can start with incomplete accounts if the gaps are clearly explained.

For example, a business with profitable work may need to bridge a delayed receipt; a business losing money on that work needs a change in pricing or costs as well. We will examine that distinction with you and, with your permission, your accountant. Read our first steps under creditor pressure.

Questions from Birmingham business owners

Do I need to stop trading as soon as I miss a payment?

Not automatically. Review whether continued trading is funded and protects creditors, rather than adding losses. A missed payment is a reason to assess the position promptly, not to carry on without a plan.

Can Vanguard help if HMRC is the main creditor?

Yes. The review can cover tax arrears, affordability and the stage of recovery action. Where a petition has been issued, its timetable needs separate urgent attention alongside any repayment discussion.

Will I personally inherit the company’s debts?

Not simply because you are a director. Personal guarantees, money owed to the company and particular conduct can create separate exposure. Bring the relevant documents so the actual risk can be assessed.

Can my accountant join the Birmingham consultation?

Yes, with your agreement. Their records and knowledge of the business can help establish the figures. Tell us who should be involved and whether any urgent deadline needs attention before a joint meeting.
